US brake pedal proposal could clear path for autonomous vehicles

Federal regulators are taking another step toward adapting vehicle safety standards for a future in which some cars may never have a human behind the wheel. The US Department of Transportation and the National Highway Traffic Safety Administration (NHTSA) have proposed updating Federal Motor Vehicle Safety Standard (FMVSS) No. 135, removing the requirement for manually operated brake pedals in vehicles designed exclusively for automated driving systems (ADS).

Although the proposal appears narrow, it marks another stage in the transition from regulations written for human drivers to standards built around autonomous technology. Rather than reducing braking requirements, the proposal shifts the emphasis toward performance, giving manufacturers greater flexibility in how vehicles achieve safe braking.

Federal safety standards are beginning to reflect autonomous vehicle design

For decades, US vehicle safety regulations assumed every passenger vehicle would include a steering wheel, accelerator pedal and brake pedal. Those assumptions reflected an era when people controlled every aspect of driving.

Purpose-built autonomous vehicles challenge those assumptions. Robotaxis designed without traditional controls rely entirely on software, sensors and redundant electronic braking systems. Requiring a physical brake pedal in vehicles that no occupant can operate has increasingly been viewed as a legacy requirement that complicates deployment without improving safety.

Under the proposed amendment, manufacturers would no longer need to install manually operated brake controls in vehicles intended solely for autonomous operation. Existing stopping distance and braking performance requirements would remain unchanged. The proposal changes how braking is initiated rather than how effectively a vehicle must stop.

That distinction matters. Regulators are indicating that safety should be measured by vehicle performance instead of mechanical design conventions established long before automated driving systems emerged.

Performance is replacing hardware as the primary measure of safety

The proposal reflects a broader regulatory direction taking shape across autonomous vehicle development. Instead of prescribing specific hardware, regulators are placing greater emphasis on whether vehicles deliver equivalent or better safety outcomes.

For autonomous vehicles, braking performance depends on an integrated combination of perception systems, computing platforms, redundant control architectures and electronically controlled braking systems. Removing the brake pedal requirement does not reduce the technical demands placed on manufacturers. It places greater emphasis on validating the reliability of the entire automated driving system.

Companies developing purpose-built autonomous vehicles have argued that unnecessary design requirements increase manufacturing complexity, reduce cabin space and delay commercialization. Allowing greater design flexibility while preserving objective safety standards enables regulators to modernize requirements without lowering safety expectations.

The proposal also highlights the growing distinction between human-machine interfaces and autonomous system performance. As automation advances, regulators are separating requirements intended for human drivers from those used to evaluate software-controlled vehicles.

Different autonomous vehicle strategies face different regulatory hurdles

The proposal could affect autonomous vehicle developers in different ways.

Tesla’s planned Cybercab has been designed without conventional driver controls, making the proposed rule particularly relevant to its future deployment. Amazon-owned Zoox has also developed a bidirectional robotaxi without a steering wheel or pedals.

Waymo has taken a different approach. Its commercial fleet largely consists of modified production vehicles that retain conventional controls. Those vehicles already comply with existing federal standards, allowing Waymo to expand operations while purpose-built autonomous vehicles continue moving through an evolving regulatory framework.

These contrasting approaches illustrate two paths within the industry. Some companies adapt existing passenger vehicles with autonomous technology, while others are designing entirely new vehicle platforms optimized for driverless operation. As regulations evolve, purpose-built vehicles may gain greater flexibility to capitalize on designs that previously conflicted with legacy safety rules.

The next phase of autonomous regulation extends beyond brake pedals

The proposed amendment has attracted attention because it removes one of the most recognizable features of traditional vehicles. In practice, it addresses only one element of a much broader regulatory framework.

Autonomous vehicle developers must still demonstrate that their systems can operate safely across a wide range of driving conditions, respond to unexpected hazards, execute emergency maneuvers and comply with reporting requirements covering crashes and software defects. Cybersecurity, passenger protection, remote assistance and system redundancy remain key regulatory priorities.

The proposal reflects a broader evolution in regulatory thinking. As autonomous technology matures, safety standards are moving away from prescribing physical controls and toward evaluating measurable performance. For manufacturers developing vehicles that may never include a human driver, that shift could remove unnecessary engineering constraints while maintaining the safety standards regulators expect.

The pace of autonomous vehicle deployment will depend on more than the presence or absence of a brake pedal. Public confidence, technological maturity and consistent safety performance will remain the factors that determine how quickly fully autonomous vehicles become part of everyday transportation.
